Abstract

It is clear that prime responsibility of the defaulter is to clear the dues as early as possible, but the question is whether he/she is the only one to be held responsible to clear the debt, or according to Sharia other organs of society are also responsible? In other words, does Islamic jurisprudence includes external factors to minimize the risk of default or late payment?
To answer this question, when we referred the prime sources of Sharia and studied the era of the Prophet Muhammad (PBUH), we found that government, relatives and rich people were advised to help in such matters and the quota for helping the defaulter is allocated in various heads. So Sharia has adopted the method of risk sharing to minimize the said risk. If all the authorities play their role effectively then the dream of welfare state and Islamic society can come true.
